1.1 Welcome to Livit

Welcome to Livit, a peer-to-peer (C2C) mobile marketplace operated by Livit Digital FZCO, a company established in Dubai, United Arab Emirates. Through our mobile app, users can list, discover, buy, and sell fashion and lifestyle products directly with one another.

In some cases, items may also be offered by approved commercial sellers or resale partners integrated with the Livit platform.

1.2 Agreement to Terms

These Terms & Conditions ("Terms") govern your access to and use of the Livit mobile application (the “App”), including any services, features, tools, or content provided by Livit.

By downloading, registering, accessing, or using the App, you confirm that you accept and agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the Livit platform.

1.3 Updates to These Terms

We may modify these Terms at any time. Changes will take effect upon publication within the App. Continued use of the App after updates constitutes acceptance of the revised Terms.

1.4 Language Versions

These Terms are available in both English and Arabic (on request). In case of discrepancies, the English version shall prevail.

1.5 Definitions

For the purposes of these Terms & Conditions, the following terms have the meanings set out below:

“App”
The Livit mobile application and related services operated by Livit Digital FZCO.

“Platform”
The Livit App and any related systems or services that enable users to list, buy, sell, or interact with items and other users.

“User”
Any individual who accesses or uses the Livit platform.

“Buyer”
A user who purchases an item through the Livit platform.

“Seller”
A user who lists or sells an item through the Livit platform.

“Commercial Seller”
A business, retailer, or professional reseller approved to sell items on the platform, including those integrated through API or partner systems.

“Listing”
Any item or product advertised for sale on the Livit platform.

“Transaction”
A purchase of an item completed through the Livit platform.

“Livit Ensure”
Livit’s buyer protection and secure payment service designed to help facilitate safer transactions between users.

“Wallet”
The balance associated with a user’s Livit account where transaction funds may be temporarily held before withdrawal.

“Delivery Confirmation”
The point at which an item is recorded as delivered through the platform’s delivery tracking or confirmation process.

Section 2 – Eligibility & User Accounts

2.1 Age & Residency Requirements

To use Livit, you must:

  • Be at least 18 years old

  • Reside in the United Arab Emirates (access from outside the UAE may be restricted or limited)

  • Be legally capable of entering into binding agreements under UAE law

2.2 Account Registration

To list or purchase items, you must register a Livit account using your mobile number, email address, or third-party authentication (e.g. Google, Apple ID).

You agree to:

  • Provide accurate, truthful, and up-to-date information

  • Keep your login credentials safe and secure

  • Promptly notify us at support@thelivit.app if you believe your account has been compromised

2.3 KYC & Identity Verification

Livit may require users to verify their identity through Know Your Customer (KYC) checks, as part of our payment provider obligations or fraud prevention systems.

Failure to complete required verification may result in account restrictions, delays in fund withdrawals, or termination.

Livit may share necessary information with payment providers and identity verification services where required to comply with payment regulations, anti-money-laundering laws, or fraud prevention requirements.

2.4 One Account Per Person

Each user may only create one personal Livit account. Creating multiple or fake accounts, or using third-party identities, may result in suspension or removal.

2.5 Business / Commercial Use

Livit is designed primarily for peer-to-peer use.

Business users (e.g. retailers, influencers, professional resellers, or high-volume sellers) may apply separately for a verified Commercial Account. Commercial users may be subject to additional verification, separate agreements, or different fee structures.

Some businesses or resale partners may list items directly on Livit through approved integrations, including API connections.

Where an item is sold by a commercial seller:

  • the contract of sale is between the buyer and that seller

  • the seller is responsible for product quality, authenticity, warranties, and applicable consumer protections

  • Livit acts solely as the technology platform facilitating the transaction

Listings from commercial sellers may be identified within the platform.

2.6 VPN & Access Restrictions

Use of Livit via VPN, proxies, or from outside the UAE may result in access limitations, especially where identity, location, or payment verification is impacted.

2.7 Account Suspension & Termination

We reserve the right to suspend, limit, or terminate any account without prior notice if:

  • You breach these Terms

  • We suspect fraud, abuse, or harmful activity

  • Required by law or payment partner

Where an account is suspended or terminated, Livit may temporarily hold wallet balances while investigating fraud, disputes, or chargebacks.

Section 3 – Platform Role & Responsibilities

3.1 Neutral Marketplace

Livit is a technology platform, not a seller, buyer, or agent in transactions between users.

We provide tools that help users:

  • List and discover items

  • Communicate through in-app messaging

  • Process payments securely

  • Coordinate shipping or handoff

We do not own, inspect, or guarantee any items listed on the platform.

Livit acts solely as the technology platform and is not a party to the contract of sale between buyers and sellers.

3.2 No Guarantee of Item Accuracy or Safety

While we encourage honest listings, Livit cannot guarantee that:

  • Item descriptions are complete or accurate

  • Items are genuine or functional

  • Items comply with brand rights or local regulations

Buyers and sellers are responsible for conducting transactions in good faith and ensuring compliance with applicable laws.

3.3 No Endorsement or Verification

Livit does not verify, endorse, or certify:

  • Any user identity (beyond optional KYC)

  • The authenticity of listed items

  • Seller or buyer conduct

We may offer user ratings, reports, or badges, but these do not constitute warranties or guarantees.

3.4 Limitation of Liability

To the maximum extent permitted under UAE law, Livit (and its directors, employees, and affiliates) is not liable for:

  • Any loss, damage, or injury related to transactions on the App

  • Missed deliveries, fraudulent listings, or defective products

  • Loss of funds due to unauthorised access, account compromise, or delayed transfers

  • Indirect, incidental, or consequential damages

Our liability is limited to the greater of:

  • AED 500, or

  • The total amount of platform fees collected on the specific transaction in question.

3.5 Dispute Resolution Between Users

Livit does not act as a mediator in disputes between buyers and sellers unless explicitly stated in the Buyer Protection Policy (Livit Ensure).

Users are expected to attempt resolution directly, using in-app messaging and order history for evidence.

Where Buyer Protection applies, we may intervene as requested.

3.6 Third-Party Services

The Livit platform may rely on third-party services such as:

  • Payment processing

  • Shipping and logistics

  • Analytics and communication tools

We are not responsible for delays, errors, or disruptions caused by these services.

Certain listings may originate from third-party inventory partners connected through approved integrations or API systems. Livit is not responsible for errors in pricing, stock availability, or product descriptions supplied through such integrations.

3.7 Force Majeure

Livit shall not be liable for delays or failure to perform obligations where such failure results from events beyond our reasonable control, including natural disasters, government actions, cyber incidents, internet outages, war, terrorism, or failures of third-party service providers.

Section 4 - Selling Process – Listings, Item Rules & Prohibited Goods

4.1 Listing Guidelines

When listing an item for sale, you agree to:

  • Provide clear, honest, and accurate descriptions

  • Upload actual photos of the item (not stock images or misleading representations)

  • Specify condition, size, price, delivery method, and any defects

  • Only list items you legally own and are authorized to sell

You are fully responsible for the accuracy of your listings.

4.2 Item Condition Definitions

For consistency across the platform, Livit uses the following condition categories:

Brand new in box
The item is completely unused and sealed in its original manufacturer packaging. The packaging has not been opened.

New with tags
The item has never been worn or used and still has the original tags attached. Packaging may be opened but the item remains unused.

New without tags
The item has never been used but the original tags or packaging are no longer attached.

Like new
The item has been used minimally and shows no visible signs of wear or damage. The item appears almost identical to a new item.

Gently used
The item shows minor signs of normal use such as light cosmetic wear but remains in very good overall condition.

Well loved
The item has been used regularly and shows noticeable signs of wear but remains fully functional and usable.

Used with flaws
The item has visible defects, damage, or significant wear that affects its appearance or usability. All flaws must be clearly disclosed in the listing description and shown in the listing photos.

For repair
The item is not fully functional or is being sold for parts, repair, or restoration. Buyers should expect the item to require repair before normal use.

4.2.2 Photo Requirements

Listing photos must accurately represent the item being sold.

Photos should clearly show:

  • the overall appearance of the item

  • any wear, marks, or damage

  • important identifying details where relevant

Livit may remove listings that do not include sufficient photos to reasonably represent the item.

4.2.3 Flaw Disclosure Requirement

Sellers must disclose all known defects, damage, alterations, or missing parts in the listing description.

Failure to disclose known flaws may result in:

  • refunds issued to the buyer

  • return of the item

  • listing removal

  • account warnings or restrictions

4.2.4 Photo Evidence Requirement

If an item contains defects or visible wear, the listing must include clear photos showing the relevant flaw or damage.

Listings that fail to display defects may be considered inaccurately represented.

4.2.5 Condition Accuracy Policy

Sellers must select the condition category that most accurately reflects the current state of the item.

If an item is materially different from the selected condition category, Livit may take corrective action including:

  • issuing a refund to the buyer

  • requiring the item to be returned

  • removing the listing

  • restricting the seller’s account

Examples include listing an item as Like new when visible wear is present or failing to disclose damage.

4.2.6 Functionality Requirement

Unless listed under the For repair category, items sold on Livit must be fully functional and usable for their intended purpose.

Any known faults or performance issues must be clearly disclosed in the listing.

Items that are not fully functional must be listed under the For repair category.

4.3 Prohibited Items

The following items may not be listed, sold, or offered on Livit:

Illegal goods
Counterfeit products
Weapons or explosives
Hazardous materials
Gift cards or digital goods
Services or live animals

Section 5 – Buying, Payments & Escrow Wallet

5.1 Buying Process

To purchase an item on Livit:

  • Browse and tap “Buy Now” or “Make Offer”

  • Choose your payment method

  • Pay via secure in-app checkout

Payments are processed through Livit’s payment partner and temporarily held as part of the Livit payment flow until delivery is confirmed.

Funds are released to the seller once the buyer confirms the item is acceptable, or automatically after 24 hours without a dispute.

5.2 Payment Methods

Payments are processed securely via our payment partner. Accepted methods include:

  • Debit/credit cards

  • Apple Pay / Google Pay

  • Livit wallet balance

All transactions are denominated in AED.

5.3 Escrow Wallet System

When a buyer makes a payment:

Funds are processed through Livit’s payment partner and temporarily held as part of the Livit payment flow.

Funds remain locked until the item is confirmed as delivered and acceptable.

After confirmation (or after 24 hours with no dispute), funds are released to the seller’s wallet.

This ensures security for buyers and payout assurance for sellers.

Section 6 – Delivery & Logistics

6.1 Delivery Arrangement

Livit arranges delivery of items through approved third-party logistics partners (“Delivery Partners”).

While delivery services are performed by Delivery Partners, Livit coordinates delivery and manages delivery-related issues through the platform in accordance with applicable UAE consumer protection laws.

Delivery fees, estimated delivery times, and service levels are displayed at checkout and form part of the digital contract between the buyer and seller.

6.2 Transfer of Custody and Risk

Risk in the item transfers from the seller to the Delivery Partner at the point of successful pickup.

Risk transfers from the Delivery Partner to the buyer only upon confirmed delivery to the buyer’s specified address.

Items lost or damaged while in transit are treated as non-delivered or non-conforming deliveries.

6.3 Delivery Confirmation

Delivery is considered complete only when:

  • the item is delivered to the address provided by the buyer; and


  • proof of delivery is recorded (such as GPS confirmation, timestamp, photo, or recipient acknowledgement).


The delivery timestamp initiates the buyer’s inspection period.

6.4 Inspection Period

Buyers are granted an inspection period of 24 hours from confirmed delivery to review the item.

During this period, buyers may report delivery issues, damage in transit, or items not as described.

If no issue is reported within the inspection period, funds held in escrow may be released to the seller.

6.5 Failed Delivery

A delivery is considered failed if:

  • the item is lost in transit


  • the item is materially damaged during delivery


  • delivery is not completed within a reasonable time after the estimated delivery window


  • the item is delivered to an incorrect recipient or address through no fault of the buyer


In the event of failed delivery attributable to Livit or its Delivery Partner, the buyer will be entitled to a refund or alternative resolution.

6.6 Buyer Availability & Incorrect Details

Buyers are responsible for providing accurate delivery information and being reasonably available to receive delivery.

If delivery fails due to buyer unavailability or incorrect information:

  • Livit may arrange a re-delivery at the buyer’s cost; or


  • the order may be cancelled, with delivery fees non-refundable.


6.7 Returns Due to Delivery Issues

Items damaged in transit or delivered in non-conforming condition may be returned in accordance with Livit’s Returns & Refunds Policy.

Where delivery fault is confirmed, return shipping costs will be borne by the responsible party as determined by Livit.

6.8 Liability Limitation

Livit’s liability in relation to delivery issues is limited to the value of the item and associated delivery fees, except where otherwise required by applicable law.

Livit reserves the right to recover losses from sellers or Delivery Partners where appropriate.

6.9 Insurance

Delivery Partners may maintain insurance coverage for items in transit.

Insurance coverage does not limit Livit’s obligation to resolve delivery issues with buyers in accordance with these Terms.

Section 7 – Returns, Refunds & Buyer Protection (Livit Ensure)

Livit’s refund process does not apply to items that simply do not fit, suit your preference, or meet personal expectations.

Refunds may apply where items are significantly not as described, damaged, or counterfeit.

Return requests must be submitted within 24 hours of confirmed delivery and before confirming that the item is acceptable.

Refunds following approved returns may include:

  • the price of the returned item

  • the Livit Ensure fee associated with that item

  • original delivery charges

  • optional service fees where applicable

Partial refunds may be offered where both buyer and seller agree.

Where an item is sold by a commercial seller, additional return policies or consumer protection rights may apply as stated on the relevant listing.

Section 8 – Fees, Promotions & Item Boosts

8.1 Free Listing Model

Users may list items for free on Livit. There are no upfront fees to create or publish a listing.

8.2 Transaction Fees

Livit may charge a small fee per completed transaction. If so, the fee will be clearly displayed before confirming the sale and may vary based on:

  • Total transaction value

  • Seller status (e.g. personal vs business)

  • Promotions or offers active at the time


8.3 Buyer Protection Fee (Livit Ensure)

To help provide a safer marketplace, certain transactions on the Platform are processed using Livit Ensure, Livit’s buyer protection and secure transaction service.

When Livit Ensure is used, a service fee will be applied to the transaction. This fee helps cover the cost of:

  • Secure payment and escrow-style processing

  • Fraud prevention

  • Dispute resolution support

  • Platform services

The applicable Livit Ensure fee will be clearly displayed to the buyer before payment is completed.

Livit reserves the right to change or update Livit Ensure fees from time to time, with updated information reflected on the Platform or in the Help Centre.

Livit Ensure is a platform service designed to facilitate safer transactions. It is not an insurance product, insurance policy, or regulated financial service and should not be interpreted as such.

8.4 Boosts & Paid Promotions

Sellers may optionally pay to boost the visibility of their listings through promotional tools such as:

  • Item Bumps – highlighted placement for a period of 24–72 hours

  • Spotlight Listings – featured placement on the homepage or in user feeds

  • Urgent Tags or Labels


Fees for boosts will be shown before confirmation and are non-refundable once the boost period begins.

8.5 Promotional Campaigns

From time to time, Livit may offer discounts, cashback, credits, or limited-time fee waivers.

These promotions may be subject to:

  • Defined start and end dates

  • User eligibility requirements

  • One-time use per account (unless otherwise specified)


Livit reserves the right to modify, suspend, or withdraw promotional offers at its discretion.

Section 8 – User Conduct & Safety

Users must:

  • Treat other users respectfully

  • Use the platform responsibly

  • Avoid harassment, abuse, or illegal activity

Users must not:

  • attempt transactions outside the platform

  • create fake accounts

  • sell prohibited goods

  • post illegal or offensive content

Users must also comply with UAE cybercrime laws.

Section 10 – Data Protection & Privacy

Livit collects certain information to operate the platform, including:

  • account details

  • device information

  • transaction history

  • user listings and communications

Data may be used for platform operation, fraud prevention, customer support, and legal compliance.

Personal data is not sold to third parties.

Users may request access or deletion of their data in accordance with applicable data protection laws.

Section 11 – Intellectual Property

All intellectual property rights relating to the Livit platform, including the mobile application, branding, design, software, and platform content, remain the property of Livit Digital FZCO.

Users are granted a limited licence to use the platform solely for its intended purpose.

Section 12 – User Content Licence

By uploading listings, photos, or other content to the Livit platform, users grant Livit a worldwide, royalty-free licence to display, reproduce, and distribute such content for the purpose of operating and promoting the platform.

Section 13 – Indemnification

You agree to indemnify and hold harmless Livit Digital FZCO and its affiliates from any claims, damages, losses, or expenses arising from:

  • your use of the platform

  • your breach of these Terms

  • your sale or purchase of items

  • violation of laws or third-party rights

Section 14 – Legal Jurisdiction

These Terms & Conditions are governed by the laws of the United Arab Emirates and the Emirate of Dubai.

Any legal proceedings must be conducted in the courts of Dubai.

Listing photos must accurately represent the item being sold.

Photos should clearly show:

  • the overall appearance of the item

  • any wear, marks, or damage

  • important identifying details where relevant

Livit may remove listings that do not include sufficient photos to reasonably represent the item.

4.2.3 Flaw Disclosure Requirement

Sellers must disclose all known defects, damage, alterations, or missing parts in the listing description.

Failure to disclose known flaws may result in:

  • refunds issued to the buyer

  • return of the item

  • listing removal

  • account warnings or restrictions

4.2.4 Photo Evidence Requirement

If an item contains defects or visible wear, the listing must include clear photos showing the relevant flaw or damage.

Listings that fail to display defects may be considered inaccurately represented.

4.2.5 Condition Accuracy Policy

Sellers must select the condition category that most accurately reflects the current state of the item.

If an item is materially different from the selected condition category, Livit may take corrective action including:

  • issuing a refund to the buyer

  • requiring the item to be returned

  • removing the listing

  • restricting the seller’s account

Examples include listing an item as Like new when visible wear is present or failing to disclose damage.

4.2.6 Functionality Requirement

Unless listed under the For repair category, items sold on Livit must be fully functional and usable for their intended purpose.

Any known faults or performance issues must be clearly disclosed in the listing.

Items that are not fully functional must be listed under the For repair category.

4.3 Prohibited Items

The following items may not be listed, sold, or offered on Livit:

Illegal goods
Counterfeit products
Weapons or explosives
Hazardous materials
Gift cards or digital goods
Services or live animals

Section 5 – Buying, Payments & Escrow Wallet

5.1 Buying Process

To purchase an item on Livit:

  • Browse and tap “Buy Now” or “Make Offer”

  • Choose your payment method

  • Pay via secure in-app checkout

Payments are processed through Livit’s payment partner and temporarily held as part of the Livit payment flow until delivery is confirmed.

Funds are released to the seller once the buyer confirms the item is acceptable, or automatically after 24 hours without a dispute.

5.2 Payment Methods

Payments are processed securely via our payment partner. Accepted methods include:

  • Debit/credit cards

  • Apple Pay / Google Pay

  • Livit wallet balance

All transactions are denominated in AED.

5.3 Escrow Wallet System

When a buyer makes a payment:

Funds are processed through Livit’s payment partner and temporarily held as part of the Livit payment flow.

Funds remain locked until the item is confirmed as delivered and acceptable.

After confirmation (or after 24 hours with no dispute), funds are released to the seller’s wallet.

This ensures security for buyers and payout assurance for sellers.

Section 6 – Delivery & Logistics

6.1 Delivery Arrangement

Livit arranges delivery of items through approved third-party logistics partners (“Delivery Partners”).

While delivery services are performed by Delivery Partners, Livit coordinates delivery and manages delivery-related issues through the platform in accordance with applicable UAE consumer protection laws.

Delivery fees, estimated delivery times, and service levels are displayed at checkout and form part of the digital contract between the buyer and seller.

6.2 Transfer of Custody and Risk

Risk in the item transfers from the seller to the Delivery Partner at the point of successful pickup.

Risk transfers from the Delivery Partner to the buyer only upon confirmed delivery to the buyer’s specified address.

Items lost or damaged while in transit are treated as non-delivered or non-conforming deliveries.

6.3 Delivery Confirmation

Delivery is considered complete only when:

  • the item is delivered to the address provided by the buyer; and

  • proof of delivery is recorded (such as GPS confirmation, timestamp, photo, or recipient acknowledgement).


The delivery timestamp initiates the buyer’s inspection period.

6.4 Inspection Period

Buyers are granted an inspection period of 24 hours from confirmed delivery to review the item.

During this period, buyers may report delivery issues, damage in transit, or items not as described.

If no issue is reported within the inspection period, funds held in escrow may be released to the seller.

6.5 Failed Delivery

A delivery is considered failed if:

  • the item is lost in transit

  • the item is materially damaged during delivery

  • delivery is not completed within a reasonable time after the estimated delivery window

  • the item is delivered to an incorrect recipient or address through no fault of the buyer


In the event of failed delivery attributable to Livit or its Delivery Partner, the buyer will be entitled to a refund or alternative resolution.

6.6 Buyer Availability & Incorrect Details

Buyers are responsible for providing accurate delivery information and being reasonably available to receive delivery.

If delivery fails due to buyer unavailability or incorrect information:

  • Livit may arrange a re-delivery at the buyer’s cost; or

  • the order may be cancelled, with delivery fees non-refundable.


6.7 Returns Due to Delivery Issues

Items damaged in transit or delivered in non-conforming condition may be returned in accordance with Livit’s Returns & Refunds Policy.

Where delivery fault is confirmed, return shipping costs will be borne by the responsible party as determined by Livit.

6.8 Liability Limitation

Livit’s liability in relation to delivery issues is limited to the value of the item and associated delivery fees, except where otherwise required by applicable law.

Livit reserves the right to recover losses from sellers or Delivery Partners where appropriate.

6.9 Insurance

Delivery Partners may maintain insurance coverage for items in transit.

Insurance coverage does not limit Livit’s obligation to resolve delivery issues with buyers in accordance with these Terms.

Section 7 – Returns, Refunds & Buyer Protection (Livit Ensure)

Livit’s refund process does not apply to items that simply do not fit, suit your preference, or meet personal expectations.

Refunds may apply where items are significantly not as described, damaged, or counterfeit.

Return requests must be submitted within 24 hours of confirmed delivery and before confirming that the item is acceptable.

Refunds following approved returns may include:

  • the price of the returned item

  • the Livit Ensure fee associated with that item

  • original delivery charges

  • optional service fees where applicable

Partial refunds may be offered where both buyer and seller agree.

Where an item is sold by a commercial seller, additional return policies or consumer protection rights may apply as stated on the relevant listing.

Section 8 – Fees, Promotions & Item Boosts

8.1 Free Listing Model

Users may list items for free on Livit. There are no upfront fees to create or publish a listing.

8.2 Transaction Fees

Livit may charge a small fee per completed transaction. If so, the fee will be clearly displayed before confirming the sale and may vary based on:

  • Total transaction value

  • Seller status (e.g. personal vs business)

  • Promotions or offers active at the time


8.3 Buyer Protection Fee (Livit Ensure)

To help provide a safer marketplace, certain transactions on the Platform are processed using Livit Ensure, Livit’s buyer protection and secure transaction service.

When Livit Ensure is used, a service fee will be applied to the transaction. This fee helps cover the cost of:

  • Secure payment and escrow-style processing

  • Fraud prevention

  • Dispute resolution support

  • Platform services

The applicable Livit Ensure fee will be clearly displayed to the buyer before payment is completed.

Livit reserves the right to change or update Livit Ensure fees from time to time, with updated information reflected on the Platform or in the Help Centre.

Livit Ensure is a platform service designed to facilitate safer transactions. It is not an insurance product, insurance policy, or regulated financial service and should not be interpreted as such.

8.4 Boosts & Paid Promotions

Sellers may optionally pay to boost the visibility of their listings through promotional tools such as:

  • Item Bumps – highlighted placement for a period of 24–72 hours

  • Spotlight Listings – featured placement on the homepage or in user feeds

  • Urgent Tags or Labels

Fees for boosts will be shown before confirmation and are non-refundable once the boost period begins.

8.5 Promotional Campaigns

From time to time, Livit may offer discounts, cashback, credits, or limited-time fee waivers.

These promotions may be subject to:

  • Defined start and end dates

  • User eligibility requirements

  • One-time use per account (unless otherwise specified)


Livit reserves the right to modify, suspend, or withdraw promotional offers at its discretion.

Section 8 – User Conduct & Safety

Users must:

  • Treat other users respectfully

  • Use the platform responsibly

  • Avoid harassment, abuse, or illegal activity

Users must not:

  • attempt transactions outside the platform

  • create fake accounts

  • sell prohibited goods

  • post illegal or offensive content

Users must also comply with UAE cybercrime laws.

Section 10 – Data Protection & Privacy

Livit collects certain information to operate the platform, including:

  • account details

  • device information

  • transaction history

  • user listings and communications

Data may be used for platform operation, fraud prevention, customer support, and legal compliance.

Personal data is not sold to third parties.

Users may request access or deletion of their data in accordance with applicable data protection laws.

Section 11 – Intellectual Property

All intellectual property rights relating to the Livit platform, including the mobile application, branding, design, software, and platform content, remain the property of Livit Digital FZCO.

Users are granted a limited licence to use the platform solely for its intended purpose.

Section 12 – User Content Licence

By uploading listings, photos, or other content to the Livit platform, users grant Livit a worldwide, royalty-free licence to display, reproduce, and distribute such content for the purpose of operating and promoting the platform.

Section 13 – Indemnification

You agree to indemnify and hold harmless Livit Digital FZCO and its affiliates from any claims, damages, losses, or expenses arising from:

  • your use of the platform

  • your breach of these Terms

  • your sale or purchase of items

  • violation of laws or third-party rights

Section 14 – Legal Jurisdiction

These Terms & Conditions are governed by the laws of the United Arab Emirates and the Emirate of Dubai.

Any legal proceedings must be conducted in the courts of Dubai.

1.1 Welcome to Livit

Welcome to Livit, a peer-to-peer (C2C) mobile marketplace operated by Livit Digital FZCO, a company established in Dubai, United Arab Emirates. Through our mobile app, users can list, discover, buy, and sell fashion and lifestyle products directly with one another.

In some cases, items may also be offered by approved commercial sellers or resale partners integrated with the Livit platform.

1.2 Agreement to Terms

These Terms & Conditions ("Terms") govern your access to and use of the Livit mobile application (the “App”), including any services, features, tools, or content provided by Livit.

By downloading, registering, accessing, or using the App, you confirm that you accept and agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the Livit platform.

1.3 Updates to These Terms

We may modify these Terms at any time. Changes will take effect upon publication within the App. Continued use of the App after updates constitutes acceptance of the revised Terms.

1.4 Language Versions

These Terms are available in both English and Arabic (on request). In case of discrepancies, the English version shall prevail.

1.5 Definitions

For the purposes of these Terms & Conditions, the following terms have the meanings set out below:

“App”
The Livit mobile application and related services operated by Livit Digital FZCO.

“Platform”
The Livit App and any related systems or services that enable users to list, buy, sell, or interact with items and other users.

“User”
Any individual who accesses or uses the Livit platform.

“Buyer”
A user who purchases an item through the Livit platform.

“Seller”
A user who lists or sells an item through the Livit platform.

“Commercial Seller”
A business, retailer, or professional reseller approved to sell items on the platform, including those integrated through API or partner systems.

“Listing”
Any item or product advertised for sale on the Livit platform.

“Transaction”
A purchase of an item completed through the Livit platform.

“Livit Ensure”
Livit’s buyer protection and secure payment service designed to help facilitate safer transactions between users.

“Wallet”
The balance associated with a user’s Livit account where transaction funds may be temporarily held before withdrawal.

“Delivery Confirmation”
The point at which an item is recorded as delivered through the platform’s delivery tracking or confirmation process.

Section 2 – Eligibility & User Accounts

2.1 Age & Residency Requirements

To use Livit, you must:

  • Be at least 18 years old

  • Reside in the United Arab Emirates (access from outside the UAE may be restricted or limited)

  • Be legally capable of entering into binding agreements under UAE law

2.2 Account Registration

To list or purchase items, you must register a Livit account using your mobile number, email address, or third-party authentication (e.g. Google, Apple ID).

You agree to:

  • Provide accurate, truthful, and up-to-date information

  • Keep your login credentials safe and secure

  • Promptly notify us at support@thelivit.app if you believe your account has been compromised

2.3 KYC & Identity Verification

Livit may require users to verify their identity through Know Your Customer (KYC) checks, as part of our payment provider obligations or fraud prevention systems.

Failure to complete required verification may result in account restrictions, delays in fund withdrawals, or termination.

Livit may share necessary information with payment providers and identity verification services where required to comply with payment regulations, anti-money-laundering laws, or fraud prevention requirements.

2.4 One Account Per Person

Each user may only create one personal Livit account. Creating multiple or fake accounts, or using third-party identities, may result in suspension or removal.

2.5 Business / Commercial Use

Livit is designed primarily for peer-to-peer use.

Business users (e.g. retailers, influencers, professional resellers, or high-volume sellers) may apply separately for a verified Commercial Account. Commercial users may be subject to additional verification, separate agreements, or different fee structures.

Some businesses or resale partners may list items directly on Livit through approved integrations, including API connections.

Where an item is sold by a commercial seller:

  • the contract of sale is between the buyer and that seller

  • the seller is responsible for product quality, authenticity, warranties, and applicable consumer protections

  • Livit acts solely as the technology platform facilitating the transaction

Listings from commercial sellers may be identified within the platform.

2.6 VPN & Access Restrictions

Use of Livit via VPN, proxies, or from outside the UAE may result in access limitations, especially where identity, location, or payment verification is impacted.

2.7 Account Suspension & Termination

We reserve the right to suspend, limit, or terminate any account without prior notice if:

  • You breach these Terms

  • We suspect fraud, abuse, or harmful activity

  • Required by law or payment partner

Where an account is suspended or terminated, Livit may temporarily hold wallet balances while investigating fraud, disputes, or chargebacks.

Section 3 – Platform Role & Responsibilities

3.1 Neutral Marketplace

Livit is a technology platform, not a seller, buyer, or agent in transactions between users.

We provide tools that help users:

  • List and discover items

  • Communicate through in-app messaging

  • Process payments securely

  • Coordinate shipping or handoff

We do not own, inspect, or guarantee any items listed on the platform.

Livit acts solely as the technology platform and is not a party to the contract of sale between buyers and sellers.

3.2 No Guarantee of Item Accuracy or Safety

While we encourage honest listings, Livit cannot guarantee that:

  • Item descriptions are complete or accurate

  • Items are genuine or functional

  • Items comply with brand rights or local regulations

Buyers and sellers are responsible for conducting transactions in good faith and ensuring compliance with applicable laws.

3.3 No Endorsement or Verification

Livit does not verify, endorse, or certify:

  • Any user identity (beyond optional KYC)

  • The authenticity of listed items

  • Seller or buyer conduct

We may offer user ratings, reports, or badges, but these do not constitute warranties or guarantees.

3.4 Limitation of Liability

To the maximum extent permitted under UAE law, Livit (and its directors, employees, and affiliates) is not liable for:

  • Any loss, damage, or injury related to transactions on the App

  • Missed deliveries, fraudulent listings, or defective products

  • Loss of funds due to unauthorised access, account compromise, or delayed transfers

  • Indirect, incidental, or consequential damages

Our liability is limited to the greater of:

  • AED 500, or

  • The total amount of platform fees collected on the specific transaction in question.

3.5 Dispute Resolution Between Users

Livit does not act as a mediator in disputes between buyers and sellers unless explicitly stated in the Buyer Protection Policy (Livit Ensure).

Users are expected to attempt resolution directly, using in-app messaging and order history for evidence.

Where Buyer Protection applies, we may intervene as requested.

3.6 Third-Party Services

The Livit platform may rely on third-party services such as:

  • Payment processing

  • Shipping and logistics

  • Analytics and communication tools

We are not responsible for delays, errors, or disruptions caused by these services.

Certain listings may originate from third-party inventory partners connected through approved integrations or API systems. Livit is not responsible for errors in pricing, stock availability, or product descriptions supplied through such integrations.

3.7 Force Majeure

Livit shall not be liable for delays or failure to perform obligations where such failure results from events beyond our reasonable control, including natural disasters, government actions, cyber incidents, internet outages, war, terrorism, or failures of third-party service providers.

Section 4 - Selling Process – Listings, Item Rules & Prohibited Goods

4.1 Listing Guidelines

When listing an item for sale, you agree to:

  • Provide clear, honest, and accurate descriptions

  • Upload actual photos of the item (not stock images or misleading representations)

  • Specify condition, size, price, delivery method, and any defects

  • Only list items you legally own and are authorized to sell

You are fully responsible for the accuracy of your listings.

4.2 Item Condition Definitions

For consistency across the platform, Livit uses the following condition categories:

Brand new in box
The item is completely unused and sealed in its original manufacturer packaging. The packaging has not been opened.

New with tags
The item has never been worn or used and still has the original tags attached. Packaging may be opened but the item remains unused.

New without tags
The item has never been used but the original tags or packaging are no longer attached.

Like new
The item has been used minimally and shows no visible signs of wear or damage. The item appears almost identical to a new item.

Gently used
The item shows minor signs of normal use such as light cosmetic wear but remains in very good overall condition.

Well loved
The item has been used regularly and shows noticeable signs of wear but remains fully functional and usable.

Used with flaws
The item has visible defects, damage, or significant wear that affects its appearance or usability. All flaws must be clearly disclosed in the listing description and shown in the listing photos.

For repair

Livit reserves the right to modify, suspend, or withdraw promotional offers at its discretion.

Section 8 – User Conduct & Safety

Users must:

  • Treat other users respectfully

  • Use the platform responsibly

  • Avoid harassment, abuse, or illegal activity

Users must not:

  • attempt transactions outside the platform

  • create fake accounts

  • sell prohibited goods

  • post illegal or offensive content

Users must also comply with UAE cybercrime laws.

Section 10 – Data Protection & Privacy

Livit collects certain information to operate the platform, including:

  • account details

  • device information

  • transaction history

  • user listings and communications

Data may be used for platform operation, fraud prevention, customer support, and legal compliance.

Personal data is not sold to third parties.

Users may request access or deletion of their data in accordance with applicable data protection laws.

Section 11 – Intellectual Property

All intellectual property rights relating to the Livit platform, including the mobile application, branding, design, software, and platform content, remain the property of Livit Digital FZCO.

Users are granted a limited licence to use the platform solely for its intended purpose.

Section 12 – User Content Licence

By uploading listings, photos, or other content to the Livit platform, users grant Livit a worldwide, royalty-free licence to display, reproduce, and distribute such content for the purpose of operating and promoting the platform.

Section 13 – Indemnification

You agree to indemnify and hold harmless Livit Digital FZCO and its affiliates from any claims, damages, losses, or expenses arising from:

  • your use of the platform

  • your breach of these Terms

  • your sale or purchase of items

  • violation of laws or third-party rights

Section 14 – Legal Jurisdiction

These Terms & Conditions are governed by the laws of the United Arab Emirates and the Emirate of Dubai.

Any legal proceedings must be conducted in the courts of Dubai.
